For Private Parties, a deposit of $150 will be required to secure your booking. For Special Promotions that are discounted from our Normal Advertised Rates – Full Payment is required upon booking. For Corporate Bookings, a deposit of Fifty Percent is required to secure booking. This deposit is non-refundable.
All bookings must be paid in full at least 5 days prior to the booking date. We accept cheques, cash and direct deposit (i.e. EFT - Electronic Funds Transfer). Also, a maximum of one Promotional SupaSumo Gift Certificate per booking but as many Fully Paid For Gift Certificates as desired is allowed.
In the event of bad weather you will need to contact us 3 hours before your event is due to start and we will allow you to transfer your booking to another time within a 12 month period. If we arrive on site due to not receiving suitable notification, no refund or transfer of booking will be accepted.
In the unlikely circumstance of the Equipment being deemed inoperable due to damage, maintenance requirements or other unforeseeable circumstances, SupaSumo reserves the right to provide an alternate piece of Equipment.
Delivery and set up
We deliver, set up and remove Equipment. We will normally arrive approximately 15-30 minutes prior to booking time. If the Hirer requests early set up or late removal an additional fee will be applied.
Our rates are based upon delivering Equipment to venues that have flat level access from delivery van. If the venue has stairs or difficult access there will be an additional set up charge P.O.A. Our operators have the right of refusal if in their opinion safety to people or damage to property or our Equipment is at risk. No refund will apply. In some cases a site inspection prior to event should be arranged to avoid this scenario from occuring.
Loss of or Damage to Equipment
If the Equipment is lost, breaks down or is damaged, the Hirer must immediately notify SupaSumo of the details. Notification shall not absolve the Hirer from their obligations under these Terms. In the event that the Equipment breaks down or becomes unsafe to use, the Hirer shall immediately stop using the Equipment and take all steps necessary to prevent the Equipment from sustaining any further damage. The Hirer must also take all steps necessary to prevent injuries from occurring to any person or property as a result of the condition of the Equipment and must not repair or attempt to repair the Equipment without SupaSumo's prior written consent. If the Equipment is lost or damaged and the loss of or damage to the Equipment is caused by the negligence or willful act of the Hirer or the breach of any of these Terms by the Hirer, the Hirer shall without limitation be liable for the following; (a) any costs incurred by SupaSumo in repairing or replacing the Equipment; (b) hire charges for the Equipment until the Equipment is repaired or replaced; (c) any other costs whatsoever incurred or loss suffered by SupaSumo as a result of the damage to or loss of the Equipment.
Release and Indemnity
The Hirer hereby releases SupaSumo from, and agrees to indemnify SupaSumo in respect of any third party claims, action, suits, demands, costs and expenses for damage or injury to person or property arising directly or indirectly out of the hire or use of the Equipment by the Hirer or these Terms.
If SupaSumo is unable at any time to perform any of its obligations whether wholly or partly by reason of any cause beyond its control (including without limitation, acts of God, inclement weather, strikes, lockouts or fires.) SupaSumo may give written notice to that effect to the Hirer, giving full particulars of such force majeure in which case the obligations of SupaSumo under these Terms shall, to the extent that they are affected by the force majeure, be suspended during the term of the force majeure. SupaSumo shall not be liable for any loss or damage suffered by the Hirer as a result of any delays caused by such force majeure.
The Hirer agrees to provide SupaSumo with a security bond of $150 upon booking confirmation to be served as a security to fulfil any of the Hirer's obligations under this contract. For that purpose, the Hirer authorises SupaSumo to withhold Security Bond for any damages caused to SupaSumo's Equipment if the Hirer breaches any part of this agreement.
If any of the Terms becomes void or unenforceable for any reason then that part will be severed from these Terms to the intent that all other parts that do not become void or unenforceable will remain in full force and effect and be unaffected by any severance of other parts. Failure by SupaSumo to insist upon strict performance of any of these Terms, or to exercise in whole or in part any right that it may have under these Terms or at law, shall not be deemed to be a waiver of any rights that SupaSumo may have and shall not be deemed a waiver of any subsequent breach by the Hirer of any of these Terms. These Terms shall be governed by and construed in accordance with the laws of the State of New South Wales.
